1. Acceptance of Terms

These Terms of Use ("Terms") form a legally binding agreement between you ("you" or "User") and Swifty Solutions Company Limited ("Swifty Solutions", "we", "us" or "our") regarding your use of the Sleep Sounds mobile application and its widget (the "App") on iOS. By accessing or using the App you confirm that you have read, understood and agree to these Terms and to our Privacy Policy, which is incorporated here by reference.

2. Eligibility

• The App is not directed to children under 13 years of age, and you must be at least 13 years old to use it.
• If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. Purchases require an Apple ID and are subject to Apple's own age requirements and Family Sharing / Ask to Buy controls.
• You are responsible for complying with all laws applicable to you where you use the App.

3. Description of the Service

The App works offline. Nothing you do in it is transmitted to us. See our Privacy Policy for details.

4. Health, Safety and Hearing

4.1 Not a medical device or treatment

Nothing in the App - sounds, tones, binaural or isochronic beats, "sleep", "focus" or "calm" labels, breathing patterns, sleep statistics or any other content - constitutes medical, psychological or health advice, and the App is not a medical device. Claims made about binaural beats and similar audio are not established medical treatments. If you have difficulty sleeping, a sleep disorder, tinnitus, epilepsy, a heart condition, are pregnant, or have any other medical concern, consult a qualified healthcare professional before using the App, and stop using it if you feel unwell.

4.2 Hearing and volume

Listening to any sound at high volume for long periods, especially through headphones, can damage your hearing. Keep the volume at a comfortable level, follow your device's volume warnings, and take care when using sounds overnight with headphones or earbuds. Do not use the App while driving or operating machinery, or in any situation where being drowsy or unable to hear your surroundings could be dangerous.

4.3 Alarm and timer reliability

The App's alarm, sleep timer and notifications depend on your device, iOS and its power, Focus, notification and background-audio settings. They may be delayed, silenced or missed - for example if the App is terminated by iOS or by you, the device is in Low Power Mode, a Focus mode is active, the battery is flat or the volume is turned down. Do not rely on the App as your only alarm for work, travel, medication, childcare or any other situation where a missed alarm could cause harm or loss; use the built-in iOS Clock alarm or another alarm as well.

4.4 Breathing exercises

Breathing patterns in the App are generic relaxation exercises. Breathe naturally and stop if you feel dizzy or uncomfortable. They are not a substitute for professional guidance if you have a respiratory, cardiac or anxiety condition.

5. Acceptable Use

You agree to use the App only for lawful, personal, non-commercial purposes. You must not:

• Copy, extract, redistribute, publish or commercially exploit the App's sound designs, synthesis algorithms, presets, artwork or software, or use them to build a competing product.
• Reverse engineer, decompile, modify or create derivative works of the App, or attempt to bypass Premium restrictions or purchase verification, except where such restriction is prohibited by law.
• Record other people without their knowledge or consent where the law requires it, or use the recording feature for any unlawful purpose.
• Resell, sublicense or share your Premium access with others outside what Apple's own terms permit.
• Use the App for any illegal purpose, or in violation of any applicable law or regulation.

We may restrict or terminate access to the App if we reasonably believe these rules have been breached.

6. Subscriptions, Lifetime Purchase and Payment

6.1 Free tier

The App may be used without payment, with access limited to a selection of sounds and a limited number of sounds playing at the same time. Free-tier limits may change over time.

6.2 Auto-renewing subscriptions

Premium is available as an auto-renewing subscription billed through the Apple App Store:

• Weekly - starts with a 3-day free trial, then renews every week.
• Yearly - renews every year.

• Payment is charged to your Apple ID at confirmation of purchase or, for the weekly plan, at the end of the free trial unless you cancel before then.
• Your subscription renews automatically at the then-current price unless it is cancelled at least 24 hours before the end of the current period (or before the end of the free trial).
• Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your Apple ID account settings (iOS Settings → your name → Subscriptions). Cancellation takes effect at the end of the current paid period; you keep Premium until then. Deleting the App does not cancel a subscription.
• The free trial is available once per Apple ID. Any unused portion of a free trial is forfeited when you purchase a different Premium plan.
• Prices vary by region and may change; changes apply to future renewals and are notified in accordance with App Store rules.

6.3 Lifetime purchase

Premium is also available as a one-time "Lifetime" purchase (a non-consumable in-app purchase). It does not renew and is not charged again. "Lifetime" means for as long as the App is available on the App Store and supported by us on the device platform you bought it for; it does not create an obligation to maintain the App indefinitely (see Section 13). A lifetime purchase can be restored on other devices signed in with the same Apple ID using "Restore Purchases" in Settings.

6.4 Refunds

All purchases are made through and processed by Apple. Refunds are handled by Apple under its own policies, and we cannot issue refunds directly. To request a refund, use reportaproblem.apple.com or contact Apple Support.

6.5 Apple standard EULA

Apple's Licensed Application End User License Agreement also applies to the App, and in the event of a conflict with these Terms in respect of the Apple-licensed application, Apple's standard EULA prevails to the extent of the conflict. You acknowledge that these Terms are between you and Swifty Solutions only, not with Apple, and that Apple is not responsible for the App or its content but is a third-party beneficiary entitled to enforce these Terms.

7. Your Data and Recordings

Your mixes, sleep log, recordings and settings are stored on your device, not on our servers. You are responsible for your own device and its backups. We cannot recover data that has been deleted, lost with a device, or removed when the App was uninstalled. You are solely responsible for the content of any sound you record, and you confirm that you have the right to record it.

8. Intellectual Property

The App, including its name, design, user interface, sound designs and synthesis algorithms, presets, artwork and software, is owned by Swifty Solutions and is protected by intellectual property laws. We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the App on Apple devices you own or control, for your own non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from the App except where such restriction is prohibited by law.

Mixes and recordings you create with the App are yours.

9. Third-Party Services

The App relies on the Apple App Store for distribution, purchases and subscription management, and on Apple's audio, notification, Siri / App Intents and widget frameworks. Your use of those services is also subject to Apple's terms and privacy policy. We are not responsible for third-party services, their availability, or changes they make to them.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL OF ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT ANY ALARM, TIMER OR NOTIFICATION WILL FIRE ON TIME, OR THAT USING THE APP WILL HELP YOU SLEEP, RELAX OR PRODUCE ANY PARTICULAR HEALTH RESULT.

11. Limitation of Liability

Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of the above may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify, defend and hold harmless Swifty Solutions and its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your use or misuse of the App, your recordings, your breach of these Terms, or your violation of any law or the rights of any third party.

13. Termination

You may stop using the App at any time by uninstalling it and cancelling any active subscription through your Apple ID settings. We may suspend or terminate your access to the App, or discontinue the App in whole or in part, at any time, including for breach of these Terms or where required by law or by Apple. Sections that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, indemnity and governing law - will survive.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date shown on this page and, where the change is material, provide notice in the App or through the App Store listing. Your continued use of the App after an update constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms or the App shall be submitted to the competent courts of Vietnam, unless mandatory consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts.

16. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Swifty Solutions concerning the App. Our failure to enforce a provision is not a waiver of it.
